Participation Agreement • Assumption of Risk • Release of Liability Waiver

We want Simply Play to be a fun, welcoming, and safe place for children and families. Please review this agreement. This agreement applies to open play, birthday parties, special events, and other parent/guardian-attended activities at Simply Play Canby LLC (“Simply Play”).

PLAY & SAFETY RULES

  • Wear designated or approved socks or foot wear in the play area

  • Follow posted rules and reasonable instructions from Simply Play staff.

  • No food or drinks allowed in the play area.

  • Use play structures, toys, and equipment as intended.

  • Be respectful of other children, families, staff, and property.

  • Avoid behavior that could reasonably cause injury to another person.

  • Notify staff of damaged equipment, unsafe conditions, or injuries.

  • Simply Play may ask a child or adult to stop an activity or leave the facility when behavior creates a safety concern or facility rules are repeatedly disregarded.

Assumption of Risk

I understand that active indoor play involves inherent risks, including slips, trips, falls, bumps, collisions, climbing, jumping, running, interaction with other children, and use of play structures, toys, and equipment. I understand that even with reasonable safety precautions, these risks cannot be completely eliminated. I voluntarily allow the child(ren) listed above to participate in activities at Simply Play and accept the ordinary and inherent risks associated with their participation.


Parent / Guardian Supervision

I understand that Simply Play is not providing childcare during open play, parties, or other parent-attended activities. A parent, guardian, or responsible adult must remain on-site and is responsible for actively supervising the child(ren) in their care. Simply Play staff may monitor the facility, provide assistance, enforce rules, and intervene when they observe a safety concern; however, staff presence does not replace parent or guardian supervision.

Health & Illness

I agree not to bring a child to Simply Play when the child has symptoms of a contagious illness or when participation would reasonably create a health or safety risk to the child or others. I understand that Simply Play is a shared children's environment and that exposure to common illnesses may occur despite reasonable cleaning and sanitation practices.


Release of Liability

To the fullest extent permitted by Oregon law, I release and hold harmless Simply Play Canby LLC, its owners, members, employees, agents, and representatives from claims arising from the ordinary and inherent risks associated with participation in Simply Play activities. This agreement is not intended to waive liability that cannot legally be waived under Oregon law.


Emergency Assistance

If an injury or medical emergency occurs, Simply Play staff may contact emergency medical services when reasonably necessary. I understand that, because a parent, guardian, or responsible adult remains on-site, that adult is responsible for medical decisions involving the child(ren) in their care. I understand that I am responsible for any medical expenses incurred on behalf of my child.


Personal Belongings

Simply Play is not responsible for lost, stolen, misplaced, or damaged personal belongings brought into the facility.


Agreement Period

This agreement will remain on file for 12 months from the date signed, unless replaced or updated by Simply Play. Simply Play may require a new agreement if its policies, activities, insurance requirements, or waiver terms materially change.


Parent / Guardian Agreement

By checking below, I acknowledge that I have read and understand this agreement and voluntarily agree to its terms. I confirm that I am the parent or legal guardian of the child(ren) listed above, or otherwise have legal authority to enter into this agreement on their behalf.

Safety FAQ

Is a waiver required for every visit?
What measures do you take for equipment safety?

Yes, safety is our top priority. A signed waiver is required for every participant before they can enter the play area. Once signed, waivers remain valid for one calendar year.

All play equipment is inspected daily before opening. We use soft-edged, non-toxic materials and maintain strict hygiene protocols, including professional deep cleaning every evening.

Are parents liable for supervised play?
What happens if someone gets injured?

Simply Play Office is a parent-supervised facility. While we provide a safe environment and staff monitors, parents or guardians remain legally responsible for their children at all times.

Our team is first-aid certified and we have fully equipped medical kits on-site. The waiver outlines the limits of liability, ensuring everyone understands the inherent risks of active play.
